Amending a Planning Permit or Endorsed Plans


Amending a Planning Permit

Where a Planning Permit has been issued and there is a proposal to change the permit preamble, a permit condition, or the endorsed plans (where the alteration would be contrary to a condition of the Planning Permit), then an application pursuant to Section 72 of the Planning and Environment Act 1987 must be submitted.

The request for an amendment to the permit will follow the same process as a new application, possibly including advertising and referral of the application.

Requests must be submitted in writing and must include:

Amending Endorsed Plans


Where a permit allows (ie. the permit contains a condition such as “the development as shown on the endorsed plans must not be altered without the written consent of the Responsible Authority”), you may request minor changes to the endorsed plans by Secondary Consent.

 Council may only amend an endorsed plan by Secondary Consent if:

  • the amendment does not result in a transformation of the proposal
  • the amendment does not authorise something for which primary consent (ie. a permit) is required under the Planning Scheme
  • the amendment is of no consequence having regard to the purpose of the planning control under which the permit was granted
  • the amendment is not contrary to a specific requirement within the permit which itself cannot be altered by consent.

Note: Changes to plans that would impact on an adjoining property, and would therefore require notice to be given, cannot be approved by Secondary Consent.

 If an amendment does not satisfy the above criteria, an application pursuant to Section 72 of the Planning and Environment Act 1987 will be required by submitting an application to amend a planning permit (see section above "Amending a Planning Permit).
