Amending a Planning Permit or Endorsed Plans


Amending a Planning Permit

Where a Planning Permit has been issued and it is proposed to change the permit preamble, a permit condition, or the endorsed plans (where the alteration would be contrary to a condition of the Planning Permit), then an application to amend the permit must be submitted (pursuant to Section 72 of the Planning and Environment Act 1987).

The request for an amendment to the permit will follow the same process as a new application, possibly including advertising and referral of the application.

An application must include:

  • A completed application to amend a planning permit form
  • A full and current Certificate of Title for the land (must be dated within the last 90 days). The title includes the covering ‘register search statement’, the title diagram and the associated title documents known as ‘instruments’, for example, restrictive covenants.
  • Plans with all changes clearly marked and a separate schedule listing all changes.
  • Payment of the prescribed application fee - see the Planning fees and charges section.  If you wish to pay by credit card, please submit your application and you will be sent an invoice which can be paid on Council's online payment portal MyGreaterDandenong.com
  • If submitting the application in hard copy, include an electronic copy of all application documents on USB flash drive or CD/DVD.

Please note: Incomplete applications will not be accepted.

Submit your application:

  • Post to Statutory Planning Department, City of Greater Dandenong, PO Box 200, Dandenong VIC 3175
  • In person to the Planning service counter at the Greater Dandenong Civic Centre, Level 3, 225 Lonsdale Street, Dandenong

 

Amending Endorsed Plans

Where a permit allows (ie. the permit contains a condition such as “the development as shown on the endorsed plans must not be altered without the written consent of the Responsible Authority”), you may request minor changes to the endorsed plans by 'Secondary Consent'.

Council may only amend an endorsed plan by Secondary Consent if:

  • the amendment does not result in a transformation of the proposal
  • the amendment does not authorise something for which primary consent (ie. a permit) is required under the Planning Scheme
  • the amendment is of no consequence having regard to the purpose of the planning control under which the permit was granted
  • the amendment is not contrary to a specific requirement within the permit which itself cannot be altered by consent
  • the amendment impacts on an adjoining property and requires notice to be given

If an amendment does not satisfy the above criteria, an application to amend a planning permit will be required - see section above "Amending a Planning Permit".
