Residential Zones and 11(2) of Building Act 1993

On 14 November 2013, Amendment C175 to the Greater Dandenong Planning Scheme came into force. The Amendment removes the Residential 1 Zone (R1Z), the residential 2 Zone (R2Z) and Residential 3 Zone (R3Z) and implements three new residential zones into the Greater Dandenong Planning Scheme: the Residential Growth Zone (RGZ), the General Residential Zone (GRZ) and the Neighbourhood Residential Zone (NRZ).

These new zones introduce new maximum height limits on dwellings and residential buildings and vary some other site controls on residential zoned land.

Section 11 of the Building Act 1993 provides that if a planning scheme contains a provision that regulates siting of buildings which is inconsistent with the building regulations and its inconsistency cannot be resolved, the building regulation ceases to have effect to the extent of the inconsistency.

The following building regulations therefore cease to have effect in the specified parts (zones) of the municipality of the City of Greater Dandenong:
