Planning Permit opposed for Waste To Energy Facility

29 July 2020

Greater Dandenong Council has strongly opposed the issuing of a planning permit for a waste to energy facility to be built at 70 Ordish Rd, Dandenong South. The applicant has appealed to VCAT to have that opposition set aside and for a planning permit to be issued.

The VCAT hearing commenced yesterday (Tuesday), with council’s legal team arguing strongly that VCAT should not issue a planning permit. The hearing will conclude on Thursday, after which VCAT will consider the matter and make a determination.

The applicant has also applied to the EPA for a Works Approval to be issued under the Environment Protection Acts 1970 and 2017. The EPA has subsequently issued that Approval. This is a separate matter to the planning permit application, and anyone objecting to the EPA issuing that approval can appeal to VCAT to have that decision overturned.
Anyone who wishes to object to the issuing of the works approval or its conditions, you may have the decision reviewed by applying in writing within 21 days of the date of issue to:

Registrar, Planning and Environment Division
Victorian Civil and Administrative Tribunal (VCAT)
7th Floor, 55 King Street, Melbourne

The deadline to submit an appeal to VCAT against the EPA Works Approval, is 4.30pm on 10 August 2020.
